Terms & Conditions

Please read these terms carefully before booking with EURO TOURS PVT.LTD

Effective Date: November 24, 2025

These Terms and Conditions establish the contractual framework between EURO TOURS PVT.LTD and our customers.

1. Payment Terms and Conditions

Deposit & Final Payment

A non-refundable deposit of [__]% is required at the time of booking. Final balance is due no later than [__] days prior to scheduled departure. Failure to remit payments on time may result in cancellation, subject to applicable fees.

Accepted Forms of Payment

Payments may be made via credit card, wire transfer, or other approved methods.

Chargebacks

Initiating a chargeback against a validly authorized charge constitutes a breach of this Agreement. We reserve the right to challenge chargebacks and recover related expenses, including attorney's fees.

2. Cancellation Policies

Client-Initiated Cancellation

Cancellations must be submitted in writing. Fees are determined based on the Supplier's policies and may include forfeiture of deposits, partial payments, or full booking value.

Agency/Supplier Cancellations

If a Supplier cancels due to operational reasons, refunds or rebooking options will follow Supplier guidelines. The Agency is not liable for costs beyond Supplier refund obligations.

No-Shows

Failure to appear for scheduled services constitutes a 'no-show' and is non-refundable.

3. Refunds, Adjustments, and Credits

Refund Eligibility

Only services explicitly refundable under Supplier terms qualify for refund. Agency service fees are non-refundable.

Refund Timelines

Refund processing may take [__] to [__] weeks, depending on Supplier and banking timelines.

Adjustments

Rate differences due to itinerary changes (upgrades, date modifications, or extensions) are the sole responsibility of the client.

4. Rates, Inclusions, and Exclusions

Advertised Rates

All rates are quoted in [currency], subject to availability and change until payment is made in full.

Inclusions

Inclusions such as accommodation, transfers, meals, and tours are clearly itemized in your itinerary.

Exclusions

Unless expressly stated, rates exclude airfare, visas, airport taxes, travel insurance, gratuities, and personal incidental expenses.

5. Responsibilities and Liabilities

Agency Role

We act solely as an intermediary between you and Suppliers (airlines, hotels, cruise lines, tour operators, etc.). We do not own, operate, control, or supervise Supplier services.

Supplier Role

Each Supplier is an independent contractor and is solely responsible for providing goods or services booked. Supplier obligations include performance, safety, and compliance with applicable laws.

Client Role

Clients are responsible for ensuring valid travel documentation (passport, visas, permits), timely payments, and compliance with entry/exit requirements.

6. Force Majeure

Neither the Agency nor the Supplier is liable for delays, interruptions, or cancellations caused by force majeure events, including but not limited to natural disasters, pandemic outbreaks, governmental actions, labor disputes, acts of war, strikes, terrorism, or other events beyond reasonable control. In such cases, refunds will be limited to Supplier policies and rebooking or credits may be offered at Supplier's discretion.

7. Limitations of Liability

The Agency is not liable for loss, injury, or damage arising from Supplier services, acts of God, or circumstances outside our control. The Agency shall not be held responsible for indirect, consequential, punitive, or incidental damages (e.g., lost profits, missed connections). Total Agency liability is strictly limited to the amount of fees actually paid to the Agency for the booking in dispute.

8. Travel Documentation and Insurance

It is the customer's responsibility to maintain valid passports, visas, permits, and compliance with health advisories or entry requirements of destination countries. We strongly recommend the purchase of comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and lost baggage.

9. Arbitration and Jurisdiction

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India.

Arbitration

Any and all disputes, controversies, or claims arising out of or in connection with this agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitral tribunal shall consist of a single arbitrator to be mutually appointed by both parties. The seat and venue of arbitration shall be [e.g., New Delhi], India. The language of the arbitration proceedings shall be English. The decision and award of the arbitrator shall be final and binding upon both parties.

Jurisdiction

Subject to the above, the courts at [e.g., New Delhi], India, shall have exclusive jurisdiction in relation to any proceedings arising out of or in connection with this agreement that are not subject to arbitration.

10. Compliance with Seller of Travel & Consumer Laws

The Agency undertakes to comply with all applicable Indian laws and regulations relevant to travel services, including but not limited to:

  • The Consumer Protection Act, 2019, governing consumer rights, redressal mechanisms, and fair-trade practices in India.
  • The Travel Agents Association of India (TAAI) guidelines and other industry standards, if applicable.
  • Applicable requirements for registration or licensing as a travel agent or tour operator under local and state laws.
  • The Information Technology Act, 2000 (as amended), concerning privacy, data protection, and digital transactions.
  • The Agency ensures that all service offerings, advertisements, and execution of tour operations are conducted in compliance with Indian trade, taxation, and consumer protection statutes.
  • Clients availing services in India have access to statutory consumer redressal mechanisms under Indian law.

11. Acknowledgment and Acceptance

By booking with the Agency, you acknowledge:

  • You have read, understood, and agreed to these Terms and Conditions.
  • You accept the terms of Supplier contracts, which govern your travel arrangements.
  • You assume responsibility for understanding all exclusions, limitations, and cancellation penalties.
